Silverpeak Traders (SMC-Private) Limited

These Terms and Conditions ("Terms") govern your access to and use of the services provided by Silverpeak Traders (SMC-Private) Limited ("we," "us," or "our"). By accessing or using our services, including our marketing platforms, event management services, and website, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using any part of the Silverpeak Traders platform—including but not limited to requesting a marketing campaign, booking event management services, using our digital tools, or browsing our website—you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Definitions

Platform: The digital infrastructure, website, and tools operated by Silverpeak Traders for providing marketing and management services.
User: Any individual or entity using the Silverpeak Traders platform or services.
Client/Merchant: A business or individual that has engaged Silverpeak Traders for Social Media Marketing, Content Marketing, or Event Management.
Services: All services provided by Silverpeak Traders, including but not limited to Social Media Strategy, Content Creation, Event Planning, and Brand Management.

3. User Responsibilities

Users must provide accurate and complete information during consultations and registration.
Users must not use Silverpeak Traders services for any unlawful, fraudulent, or abusive purposes, including the promotion of prohibited content.
Clients must adhere to all applicable local laws and social media platform guidelines when utilizing our marketing services.

4. Company Responsibilities

Silverpeak Traders shall make reasonable efforts to deliver high-quality marketing and event services as per the agreed-upon scope of work.
We will facilitate project updates, campaign reporting, and event coordination according to our internal service standards.

5. Limitation of Liability

To the fullest extent permitted by law, Silverpeak Traders is not liable for:

Third-party platform failures (e.g., Facebook, Instagram, or Google outages).
The performance or ROI of marketing campaigns, as results can vary based on market conditions.
Indirect, incidental, punitive, or consequential damages.
Liability is limited to the service fee paid for the specific project in question or PKR 10,000—whichever is lower.

6. Termination of Access

We reserve the right to suspend or terminate access to our services at any time, with or without notice, for any reason, including violation of these Terms or non-payment of service fees.

7. Force Majeure

Silverpeak Traders shall not be held responsible for any failure or delay in service due to causes beyond our control, including but not limited to acts of God, natural disasters, internet outages, cyberattacks, or governmental restrictions affecting events or digital advertising.

8. Cookies & Tracking Policy

Silverpeak Traders may use cookies and tracking technologies to improve your experience. By using our platform, you consent to:

Essential Cookies: Required for website functionality and security.
Analytics Tools: Usage of tools such as Google Analytics or Meta Pixel to monitor patterns and improve our marketing performance.

9. Usage Policy & Content Rights

Permitted Use: Our marketing strategies and content are provided for the client's specific business use as outlined in their contract.
Intellectual Property: Unless otherwise agreed in writing, Silverpeak Traders retains ownership of original strategies and templates, while clients retain rights to their specific brand assets.
Security: Clients are responsible for maintaining the security of any shared dashboard credentials or account access provided by us.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Pakistan.

11. Amendments

We may amend these Terms from time to time. Users will be notified via website notice or email. Continued use of the service constitutes acceptance of the updated Terms.
